easement

easement

After a post on this board I did my own investigating.  I inquired if an EA was required  before the easement decision.

Hello
I would like to know possibly when a decision will be made on the easement of surface land use by Cliffs Natural Resources on KWG land claims.
Is an enviromental assessment from Cliffs required before a decision is made?
Thank you for your time

Response:

Hello,

Thank you for your inquiry.

Cliffs Natural Resources is required to have an approved environmental assessment under Ontario’s Environmental Assessment Act before any decisions or authorizations are made by the Ministry of Natural Resources with regard to the easement for surface rights. You are encouraged to contact Cliffs for the scheduled submission date of the environmental assessment to the Ministry of Environment for approval.

Regards,

Hi Bruce

I just got response back from MNR see below

Does this mean that you must allow them to do an EA on our claims before there is a decision on the easement?

Can CCC proceed to build the RR without this decision?

What is going on?

The Mining Commissioners do not require anything to render a decision on the easement. They are an independent judicial body. As for the MNR, it seems from the response below that they might require an approved EA. There is nothing stopping us from moving ahead with the railway, however, we too must go through the EA process before construction could begin.

Bruce.

I then Asked Bruce if Cliffs is allowed to do work on our claims

Response:

No, we have not given anyone permission to do work on our claims. No they cannot do work on our claims without permission.

So there you have it.  The decision does not require an EA and  Cliffs  will need KWG permision to access the claims to carry out  an EA before they can do anything.  KWG will need an EA as well before they can build the RR as well.
