Chief, you are absolutely right.  It's not that difficult to see fuming frustration of  G&W  when we read their two requisitions and a response.  Graeme is EXTREMELY SKILLED in survival department. HE IS A MAGICIAN.  Apparently his lawyers are not the worst in the business either.  Of course it's obvious that the one and only reason, for Graeme to announce AGM more than 6 months in advance, was to deny possibility of Special Meeting.

This was, as per G&W completely artificial and a sham.  WE MUST WAIT 6 MONTHS WITHOUT RIGHT TO ASSEMBLE AND LEGALLY EXPRESS OUR VIEWS??? 

How on this planet earth ANY COURT can see this as appropriate and ethical action and not a trickery?

 

IT'S A MESS NOW.   I completely see your point, at the same time G&W put forward Second requisition after apparent decision that their official response on BNC's refusal won't cut it.

It  came AFTER set up date of AGM, so probably they didn't see this as a mortal wound but......  I guess they feel that there's a problem.   Again that's why they insist on VALIDITY OF THEIR FIRST REQUISITION.

 

Look, that's what we've got in the end  -   if BoD is right, then due to unexcusable and stupid mistake of G&W  (I definitely hope that's not the case and Graeme's lawyers are wrong) OR due to skillful actions of Graeme and his lawyers we've got a situation.

As I stated, for me it's quite important, THE REPUTATION OF G&W IS AT STAKE HERE - It's their first public fight with Graeme and his BoD right before our eyes.

 

Me stupid thought that getting The Meeting would be the smallest of our problems.

I'm not a lawyer, but will dare to state that in my opinion requirements for proper filing of Requisition shouldn't be extremely difficult thing to know in advance, comply with and act upon. 

(as per BoD "...  the law on the form of a requisition made by a shareholder is both settled and clear.    ....." )

 

High Tea might be right - lawyers may have their day now.....   Quite bizzare thing.  What an embarassment  it must be for the lost side after the smoke clears.

I would say that at a score table Mr. McRae IS WINNING as of now.   AT THE VERY LEAST HE'S APPARENTLY BUYING HIMSELF MORE PRECIOUS TIME.
