The B.C. government says it was fully within its rights when it refused to issue an environmental certificate for Pacific Booker Minerals Inc.'s Morrison gold-copper mine. Although federal and provincial assessments had concluded that the mine would not have any adverse environmental effects, the final decision rested with two cabinet ministers who were entitled to use their own discretion. Those ministers, Rich Coleman and Terry Lake, had to consider the risks to water quality and the strong presence of Indian groups in the area of the mine, the government claims.

The government is responding to a petition that Pacific Booker launched in the Supreme Court of British Columbia on April 3, 2013. The company sought to overturn the rejection of its environmental application for the Morrison mine near Smithers, B.C. Pacific Booker said that the government's refusal to issue a certificate for the mine was based on erroneous information, including an assumption that the mine was in the headwaters of the Skeena River.
