That seems to be the case as of right now, my guess is that it will be dismissed.... these rarely get anywhere anyway. It's too hard to prove things in these situations.... the best defense is ignorance! Heins on the stand: "but I really thought (relevant artist) Alicia Keys concert tickets would move our devices. IT dept heads love Alicia keys, don't they?" or "English as my second language and being tall and lanky should not be considered a factor in the lack of share appreciation."
