Can't say for sure on the BGM gold loan deal as I haven't read it detail, but failure to deliver on a gold loan often does involve a company losing the mines it pledged as collateral for the loan.

A recent example was White Tiger (aka Century) which lost a mine in Quebec and in Peru when it failed to deliver a gold loan payment.  I can't imagine Sprott would be so kind as to write a kinder and gentler gold loan agreement favoring the company -- i.e late payments can be paid with paper....
