take a peek at Exhibit 10.1 page 7 - 2d and e and hate to bust your bubble but it appears as though the expenditures are to be completed by the 3rd anniversary of this agreement which is date March 28th, 2011 so I would be of the understanding that there is not a problem from the same document you reference too.
