News for the Puda Class ActionIt appears that a number of plaintiffs, including Hotel Ventures, have just filed for leave to submit a amended consolidated complaint.
In my limited experience with these actions, I see this frequently and it is usually a sign that the Consolidated Class for whatever reason, needs to delay the proceedings for what might be a lengthy time in the neighborhood of months, not weeks.
In connection with this filing, there has been a sealed document filed with the clerk.
"PLEASE TAKE NOTICE that as soon as the matter may be heard before the Honorable Katherine B. Forrest, United States District Judge, at the Daniel Patrick Moynihan United States Courthouse, 500 Pearl Street, Courtroom 15A, New York, New York 10007, Plaintiffs will move the Court for an Order, pursuant to Rule 15(a)(2) of the Federal Rules of Civil Procedure, granting Plaintiffs leave to amend to file their proposed Consolidated Amended Complaint. This Motion is based upon the accompanying [Corrected] Memorandum of Law and the Declaration of Laurence Rosen, dated January 2, 2014, filed herewith, on Federal Rule of Civil Procedure 15(a)(2) and the papers filed on the instant action. PLEASE TAKE FURTHER NOTICE that Plaintiffs respectfully request oral argument on this motion. Dated: January 6, 2014 Respectfully submitted, THE ROSEN LAW FIRM P.A."
