  Makes absolutely zero difference whether there is fraud or not.  Makes absolutely zero difference whether the lawsuits are based on legitimate clains or not.  The ONLY reason the Bre X suits have now died  is that the lawyers have realised there is no money available.  While PVG and /or SSO have any corporate cash potentially available,  we can expect the lawsuits to continue thru the legal process.
