Let's say we file an appeal. An appellate court rules our expert in fact was qualified to testify about drilling costs and orders a new trial. THEN WHAT??? You want to go THERE???? Nobody in their right mind wants that.
Maybe you appeal to win that point and then have leverage for negotiation? I don't think that's the best strategy but it is a strategy to preserve your rights. Not my first choice, though filing might be necessary.
