5/14/2014 | | Minute Order [non-document]: A status conference was conducted on 5/13/2014 before Judge Sara Lioi. Attorneys Justin A. Nelson, Daniel J. Shih, and Jordan L. Talge participated on behalf of plaintiffs, and David Hickert attended as plaintiffs' company representative. Attorneys Kip T. Bollin, Tracy Z. Quinn, and Kirsten R. Rydstrom participated on behalf of defendant Saint-Gobain Ceramics & Plastics, Inc. (Saint-Gobain), and Tom Fields attended as the company representative. Attorneys Brian A. Rosenthal and Robert E. McBride participated on behalf of defendants Philips Healthcare Informatics, Inc. dba Philips Healthcare and Philips Medical Systems Cleveland, Inc. (Philips), and Doug McKnight attended as the company representative. After conferring in chambers with lead counsel for all parties and affording counsel an opportunity to meet and confer, the Court resolved a number of issues on the record. Zecotek shall notify defendants on or before 12:00 PM (EDT) on 5/16/2014 whether it intends to rely upon plaintiff Beijing Opto-Electronics Technology, Co. (BOET) for any aspect of this case. If so, Zecotek will produce documents from BOET by 5/30/2014, and the parties shall complete depositions of BOET's document custodian(s) by 6/30/2014. After discovery regarding BOET is completed, plaintiffs shall file a motion to dismiss all of BOET's claims with prejudice. If plaintiff Zecotek determines that it will not rely upon BOET for any aspect of this case, then plaintiffs shall immediately move to dismiss BOET's claims with prejudice. Zecotek and Saint-Gobain shall each allow re-deposition of their document custodians, which shall be completed by 8/15/2014. Accordingly, Doc. No. 218 , which the Court had referred to Magistrate Judge Limbert, is now moot. Zecotek shall complete its privilege log review and produce any remaining non-privileged documents by 5/23/2014. As previously ordered by Magistrate Judge Limbert (Doc. No. 167 ), Philips shall produce financial documents to Zecotek by 5/23/2014. The Court granted plaintiffs' motion to withdraw their objections (Doc. No. 185 ) to Magistrate Judge Limbert's 1/10/2014 discovery order. (Doc. No. 180 .) Depositions shall hereafter take place in the continental United States, with the exception of named inventor Alexander Zagumennyi, who is unable to travel to the United States. Counsel shall confer and determine an alternate location for Mr. Zagumennyi's deposition. Zecotek shall make a complete answer to Saint-Gobain's third and fourth interrogatories by 5/30/2014 and shall be sanctioned, up to and including dismissal of its claims, if it fails to do so. Zecotek and Philips shall meet and confer to determine whether the discovery dispute referred to Magistrate Judge Limbert (Doc. No. 215 ) is now moot in whole or in part and shall notify the Court and Magistrate Judge Limbert accordingly. Finally, the Court discussed with counsel the dates and deadlines that shall appear in the Court's contemporaneously filed Case Management Plan II and Trial Order. The Court scheduled a telephonic status conference, with counsel only, for 8/12/2014 at 12:00 PM, at which time counsel shall be prepared to discuss whether early dispositive motions on discrete issues not requiring expert testimony would be appropriate in this case.
