Also interested to know what the "class" will be defined as. Any lawsuit would have to allege misrepresentation. In January the company announced that it needed to restructure and that would involve bankruptcy proceedings. That is exactly what occured. That may be the first honest press release the company ever made.

So there can be no claim of misrepresentation by anybody who purchased their shares after the January press release was made. They acquired them with full knowledge that a bankruptcy filing was likely so they were not "damaged" when such a filing occured.
