The point that is being missed here is that CUS couldn't get a quick bench ruling so the contractual terms / obligations are not clear and immediately enforceable. In other words MEG has CUS by the short and curlies - CUS needs the tie in, MEG is a customer and any parties interested in purchasing NATO will head for the hills and wait for the dust to settle on this issue. Yes, MEG and CUS could reach a deal prior to the market opening on Monday, although the dispute heading to court shows that an negotiatoin has failed so far, but it certainly will be at CUS's expense. I think one CIBC analyst described it as a "nightmare" and it just gets scarier.
