interesting article but this isn't a criminal case, it is a civil intellectual patents case you don't have trial by jury--it can only be by judge or a tribunal of experts if that is what they are meaning (as to my understanding). A jury and electing judge and jury or judge alone depends on the type of criminal offence at least in Canadian law. Like I said, this is simply corporate/civil law and no there doesn't have to be proof beyond a reasonable doubt (lol) it will be based on a balance of probabilities in which the plaintiff (if it goes to litigation) NVida will have to prove its case at 51% or higher to win. Not too worried though, these are common and this will most likely be resolved out of court although yes, it will most likely result in some punitive damages but nothing that will cripple Samsung and lets say even if it hurt it--we are also dealing with Sharp, Panasonic, Roku, Vizo and more than just one company albeit they absolutely help our earnings but I don't even see this as being much of a factor as to what we have. glta
