Puda Coal, Inc. (Puda) is a supplier of high-grade metallurgical coking coal to the industrial sector in the People’s Republic of China (the PRC or China). Its processed coking coal is primarily purchased by coke and steel producers for the purpose of making the coke required for the steel manufacturing process. Puda’s operations are conducted by Shanxi Puda Coal Group Co., Ltd (Shanxi Coal), which it controls through 90% indirect equity ownership. Puda cleans raw coking coal sourced from third-party coal mines primarily located in Liulin County, Shanxi Province, and markets the cleaned, coking coal to coke and steel makers. Its primary geographic markets include Shanxi Province, Inner Mongolia Autonomous Region, Hebei Province, Beijing and Tianjin, China. It purchases raw coal from a diversified pool of local coal mines in Shanxi Province.

1:11- cv-2598 is the class action suit. The SEC case is 1:12-cv-01316. The 270m demand is what the plaintiffs have asked for in the class action. The inferences are, as you stated, that it appears he wants to settle but this is not the first try. The last was some 18 months ago. I would say that there is a disagreement but I can only assume it is with the lead plaintiffs and it has to do with the numbers. He could also be simply buying time for something else, and I don't know what it could be.....yet... As to conclusions, I learned some time ago that it's not a good idea to make them until more facts are available and with these legal suits, it is rare to have facts available to make a call. So....keeping that in mind, I would not think about the chances of a share buyback or going private transaction at this time. The chances of it happening at this late stage are very slim, but we cannot see into his mind, we do not have a good grasp of his financial condition except to say that it is probably badly damaged from earlier reports in China. A buyout would therefore require outside investment and I have no facts to report on any efforts of that kind. A global settlement can take many forms and any amount of money or particulars. All we can do is keep up with the courts and hope we can recover something..
