They all say Nord Gold WOULD make an offer if they are allowed. BUT THE FACT IS THEY WEREN'T AND NEVER MADE AN OFFER.

In addition, the potential offer was contingent on unwinding the AuRico JV. (The PP had not yet taken place so was not an issue). It is not clear if Carlisle could unwind the AuRico JV, they had received $5m and could have faced legal consequences if they broke the agreement.

The question of whether the JV is better than a theoretical 9.6 cent takeover is not a short term assessment. The board must take a longer view. If AuRico was not in the picture, I am sure that shareholders would have griped about only getting 9.6 cents - would it have been hostile? If Nord Gold had come first and then AuRico made the JV offer, personally I would have chosen the AuRico deal, and obviously so would the board of directors who own 30+ million shares (do you think they are interested in the shareprice?).

There are plenty of "ambulance chasing" law firms or you could try Siskinds to get a class action going but not sure on what grounds???
