The LOGM decision is eligible for appeal to the Supreme Court (SCOTUS) as are most (if not all) court decisions but the court accepts or rejects cases based on fundamentals of law or the importance to US national interest. One exception of note was Microsoft versus i4i which the court heard because...well it was Microsoft.

In the LOGM case the CAFC gave a clear and unarguable one word decision; `AFFIRMED` which speaks volumes about fault. Not the judge. Not the jury and not the defendants lawyers. Fault lies wholely with B&H and their lawyers. I suspect that B&H would rather let the case quietly fad from memory - and it will except for the handful of investors (like myself) who got blind sided and burned by the fiasco. Just part of the learning curve of how the markets work.
