Last I heard is not illegal to go broke although VFX's collapse seemed extra-ordinarily rapid and complete. It seems you believe somebody with Merchant's status and notoriety is pursuing a vapour. Perhaps you also believe Jason put his life's work and assets on the line to commit fraud intentionally which is the only actionable offense if it did occur. As a VFX shareholder I have serious reservations about a number of events that don't make a lot of sense. Perhaps you can show this board the case file for the class action. If this does not exist it would raise issues of shareholder oppression.

Not sure if you are familiar with the Virtutone story but the case for the class action has been well documented on this board (i.e. allegations that Mr. Allen reporting only his insider purchases and not his insider sales, allegations of deceiving shareholders about the $10M LOC from a Tier 1 bank, etc.).  I would suggest reading some of the board posts and then you can make a decision on whether or not you want to join the class action.  Like I've said previously, I'm not expecting to rececive any compensation back but what is there to lose at this point?
