RE:Big IF for WiLANFor me it's always been a question of 'when' not 'if' charm.  The biggest settlements are the hardest and take the longest to win.  Apple used their clout and high-priced legal savvy to decieve and take advantage of a sympathetic jury.  That's where the weight of the blame should fall, not on McKool-Smith IMO.  Now this matter rests in the hands of appeals court Judges experienced in patent law.  Remember the Judge in the Apple trial would not have granted Wilan the appeal if he felt they didn't have a case.  In their defense I can't see Apple providing any convincing argument.  The one they used to win with is not going to fly this time around.

As for Ericsson it appears the market has already priced in a trial loss.  I think everyone is rushing to judgement based on Wilan's past.  I'm counting on a win.  The good news is that we will all know in a couple of weeks..or maybe sooner.
