RE:the real scoop?valueseeker123, what you're saying is that Zecotek initiated a patent infringement lawsuit so they can lure Philips away from St. Gobain?
If I recall, posters were touting the $100's of millions in potential damages that could be awarded to Zecotek if they won the lawsuit, which they did not win.
I doubt it very much that a law firm would take on a case in order to win sales for their client. That's laughable if you think about it.
FWIW, BOET's claims and St.Gobain/Philips' counterclaims against one another were declared MOOT, except that BOET's claims were dismissed "with prejudice" while St.Gobain/Philips' counterclaims were dismissed "without prejudice", meaning St. Gobain/Philips can at any time if they deem warranted, continue their claims against BOET. Correct me if I'm wrong.
In my opinion, you should stop dreaming about a deal with Philips. Hamamatsu is partnered with Zecotek, so maybe you should stick to what Hamamatsu has accomplished since first ordering ZMS crystals 2 years ago.
What is it, $2 or $2.5 million in orders in 2 years? Good luck to all here.
valueseeker123 - (6/8/2015 11:34:20 PM) the real scoop? Here's what we know FOR SURE.
Phillips was buying crystals thru St. G.
ZMS was suing St. G.
Now we know that the lawsuit has disappeared.
Let's SUPPOSE that St. G. was infringing on ZMS's patent. ZMS found out Phillips was aware that they were knowingly buying a ripped off crystal.
ZMS secures the Markman and can either go to war with St. G. and pay many millions in fees and take years, OR....
Phillips needs crystals. ZMS agrees to drop any future lawsuit against Phillips in return for a long term commitment to buy from ZMS.
