Of course, Zenith is not insolvent. So you can't do that directly. Instead, you put a little "IF" clause in your statement. IF you redefine insolvency in a way that it has never been defined before, you can then label them "insolvent" or "bankrupt" under your new definition of those terms.
Interestinly, you very cleverly REMOVE THEIR KEY ASSET FROM YOUR NEW DEFINTION: THEIR PATENTS and IP. That's so very clever of you.
You can't do that in fairness. The result is a smear.
If your intentions are good, you'd correct yourself and apologize for being so misleading. But you won't do that.
