Stans AGM Sept 24th. 2015Like 4putt, I attended the AGM and I fully concur with 4putts expressed takeaway in his Sept 24 post to this board. At the start of the AGM open session, I expressed my concern and postulated the Kyrgyz game plan appeared be to delay, delay proceedings in order to bankrupt Stans in the process. Hence, I raised the question How is Stans going to fund corporate On-Going corporate overhead costs, excluding corporate costs in relation to the International Arbitration Proceeding Against The Republic of Kyrgzstan, which will be funded by Calunius Capital? I was told Calunius could provide additional funding to assist Stans to manage cash flows during lengthy proceedings. Also Stans had the option to sell assets or go to the market to raise funds. My second question during the open session was:- Has the Ontario Superior Court of Justice set a date for Stans case file to be heard pertaining to Stans seeking recognition and enforcement of the Moscow Chamber of Commerce and Industry (MSCI) $118M US Award? If so what is the hearing date? David Vinokurov replied and said No Date had been set by the court. Boris Aryev Chief Operating Officer & Director gave a further an enlightening and informative reply. Boris basically stated :- Before proceeding with Stans case file before the Ontario Superior Court of Justice. (the Court) Stans must allow all Russian litigation to be completed. This included Stans appeal to the written ruling of the Moscow City Arbitrazh Court to the Supreme Court of Russia. Reason:- Stans intends to demonstrate to the Court Bias and Lack of Impartiality on the Part of Moscow/Regional Arbitrazh Courts. To do so Stans must allow Russian litigation to run its course. (Other western courts have disregarded setting aside judgements of the Moscow City Regional Arbitrazh Courts in circumstances of lack of impartiality.) Also I gather another reason for the delay is a new Judge is or will be appointed to the Ontario Superior Court of Justice. I left the meeting personally with renewed CONFIDENCE, that Stans eventually will be successful in obtaining recognition and enforcement of the award either by the Ontario Superior Court of Justice or thru new international arbitration proceedings.
