Perhaps the problem ultimately rests with a structural disincentive created by Canada's tax and securities laws, Grat. Currently a company can accrue all the management fees it wants, leveraging these fees against an asset that can be sold at any point for a substantial sum of money, which then could be used to repay all the accrued fees. The more valuable the asset, the longer one can go on with the accruing and have a degree of certainty that these accruals will be paid. This situation might be a lot different, if management fees could not be accrued at all or if they were limited to a specific dollar amount and/or period of time.
