I respectfully disagree Estreet. I think it was an embarrassingly unprofessional and biased interview on BNN's part. Why do people hate on whistleblowers? This guy might be making money off of his thesis but it doesn't mean he's wrong, he has a successful track record and has conviction in his research. If anything, it shows us all that nobody has done enough of it. I am glad there are people out there keeping the corporate elite accountable, it's in the best interest of all investors. Questioning actions that are taken by a management team is not a crime.
According to the Rosen class action lawsuit:
"Defendants made false and/or misleading statements and/or failed to disclose that: (1) Nobilis claimed success rates for its AccuraScope procedure lacked recognition from any university, medical body, or insurance company; (2) Nobilis overstated its 2014 revenues by as much as $36 million; (3) consequently, Nobilis misrepresented its 2014 revenue growth rate as 161%, when it was actually only 44%; and (4) as a result of the foregoing, Nobilis's public statements were materially false and misleading at all relevant times. When the true details entered the market, the lawsuit claims that investors suffered damages."
Maybe there's nothing to them but combine the allegations made in the SA article with Fleming's divestiture and retail investors really don't think the market is justified being wary? Retail can be angry, call Left arrogant blah blah blah. The market has determined his allegations hold some weight, just as it determined the SA author's allegations hold some weight. There is too much uncertainty and doubt for big money to make a sound investment decision right now so the market is derisking the stock.
