For real? You owned this Baja stock during this time period? Doesn't BGM had $450k set aside for litigation fees, maybe regarding FC. I think I saw in MD A.
A class action has been commenced on behalf of all persons and entities, wherever they reside or be domiciled, who acquired Baja Mining Corp. securities between November 1, 2010 and April 23, 2012 (the “Class Period”) and who held some or all of those securities as of April 23, 2012.
On April 22, 2014, the Ontario Superior Court of Justice granted permission (known as “leave to proceed”) under the Ontario Securities Act and certified the action as a class proceeding. The leave to proceed and certification order means that the Court has permitted the action to proceed to trial as a class proceeding and has granted permission to the Plaintiff to pursue the statutory claims under the Ontario Securities Act on behalf of the class.
A settlement has been reached with the defendants in which $11,000,000.00 will be paid for the benefit of Class Members (the “Settlement”). In exchange, the defendants will be provided with a full and final release of claims made against them in relation to the facts and issues alleged or which could have been alleged in the Baja Mining Class Action Lawsuit. The defendants do not admit any wrongdoing or liability in relation to the Baja Mining Class Action Lawsuit. The Settlement represents a final resolution of all issues contained in the Baja Mining Class Action Lawsuit.
Remain in the Class (do nothing) If you want to participate in the Class Action, you do not need to do anything to continue to be included as a Class Member. As a Class Member, you will be entitled to participate in any settlement and/or judgment and you will be legally bound by the result of the Class Action.You will also be bound by the terms of any judgment or settlement, whether favourable or not, and you may not opt-out of this action in the future.
Exclude yourself from the Class The time for Class Members to opt-out of the Baja Mining Class Action Lawsuit has passed. The deadline to do so was June 1, 2015. If you did not previously opt-out, you are legally bound by the result of the Baja Mining Class Action Lawsuit, including the Settlement once approved.
