The lawsuit is not available on line yet. In fact we have not even been served with the notice. We just happened to find out about it indirectly by doing a legal review.
It is related to an explosion that occurred at one of our client’s facilities in January of 2014. The lawsuit has
named several consultants, several manufacturers, the Ontario Electrical Safety Authority and a number of “John Does” (unnamed individuals and corporations). It is BIOREM’s opinion that the system that was provided to the client:
· Had the design approved by the Owner’s engineer
· Had the installation approved by the Owner’s engineer
· Had the installation approved by the Electrical Safety Authority
· Was in operation without incident for 4 years
We are also aware that the system was not being operated in a manner that was intended for continuous use. We suspect this will be a negotiated settlement between the various parties as the responsibility for the project is distributed among a large number of individuals.
Our relationship with the Region and the various parties is strong, and we have continued to do business with all of them, including several systems at the same facility. Biorem maintains Errors & Omissions as well as General Liability insurance.
While this is an unfortunate turn of events, given the momentum we have been able to achieve over the last year, I remain positive that we will be able to handle this in an appropriate manner.
