RE:Embraer is a POOR LOSERThe very same "unfair subsidy" complaints from Embraer were formally brought forward in the late 1990s once it became clear to the industry that Bombardier's CRJ was winning the sales race to sell regional jets. Bombardier beat it's own target goal of 1,000 CRJs sold, 2 years ahead of their own 2001 target).

The Embraer compaint drew a lot of media attention,  for months, such as this one will. At  the time Bombardier demonstrated they had played by the rules of foreign trade and the Embraer complaint was later dropped.

This might explain why the fed has not yet pronounced itself with a long term "aid" solution. 

I seriously doubt the CDPQ or the prov. Qc. government moneys can be contested as "unfair subsidies" as these deals were structured to meet foreign trade rules. 

The good news is the complaint also confirms that Embraer is very concerned about loosing out on some recent big sales and, that it has fallen behind Bombardier in terms of its own competitive advantages in the industry i.e. cheap planes.
