has NOTHING to do with insider trading. It's a completely separate offence under different legislation. Also it does not matter if anybody believes the published false or misleading statement. That is not an necessary element of the offence in fact the proof of somebody belig mislead is explicitly excluded as a necessary element (see below right from the act)
As for whether enforcement will act well that's true. Canada sucks at enforcing laws but there are provisions for private prosections of criminal offences. Believe me I've been involved with them.
Proof of certain matters not required
(1.1) For greater certainty, in establishing that subsection (1) was contravened, it is not necessary to prove that
-
(a) any person was deceived or misled;
-
(b) any member of the public to whom the representation was made was within Canada; or
-
(c) the representation was made in a place to which the public had access.
