I don't have the time to layout all the evidence that would be needed to support proof of each element of the offence but your lawyer friend might be able top give you the general legal principles like intentional versus accidental, fault elements like recklessness or knowingly etc.
Discussing the potential of a buyout would not meet the elements of offence. Seeking alpha and others have published and discussed this BTE buyout possibility as you pointed out. Where number1hit and other PROdick alias have crossed the line is when they make false or misleading statements like "the buyout next week" as if it a certanity. Fullreversal published similiar statements earlier this year. Seems to me this statement is both false (to our knowledge) and misleading and made either knowingly or recklessly.
As for private prosecutions there is a whole section on the criminal code for the procedure to initiate. I do not know if competition act offences have ever been privately prosecuted but that irrelevent to my original point that they certainly can be. As I said I've been involved in them and am currently involved in assessing the evidence available to decide whether a private prosution is wartranted in an unrelated matter.
