RE:Updated 'Relevant to this board' Health Canada InfoThanks for the information. Sounds like Hemplify meets the IHR but not the other regulations. You have to think that regulations are being drafted to permit the sale of CBD based products.

Thank you for your inquiry regarding the importation of products containg hemp extract made from the stalk of industrial hemp. Please note that cannabis, which includes hemp and its derivatives, is listed in Schedule II to the Controlled Drugs and Substances Act (CDSA) and the Schedule to the Narcotic Control Regulations (NCR). Therefore, the possession, importation, exportation, production, distribution and sale of all forms of cannabis, regardless of the tetrahydrocannabinol (THC) and cannabidiol (CBD) concentration, are prohibited unless authorized under a licence or an exemption of the CDSA. Cannabis is currently regulated under three regulatory frameworks to the CDSA, the Industrial Hemp Regulations (IHR); the Narcotic Control Regulations (NCR); and the Marihuana for Medical Purposes Regulations (MMPR). Depending on the activities you wish to conduct and any proposed product(s) to result from the undertakings, additional licences may be required. Based on the information provided below, it appears that the proposed product contains hemp extract made from the stalk of the hemp. In accordance with the definition in the IHR, industrial hemp does not include plant parts of the genera Cannabis that consist of non-viable cannabis seed, other than its derivatives, or of mature cannabis stalks that do not include leaves, flowers, seeds or branches, or of fibre derived from those stalks. As such, mature cannabis stalk is not regulated under the CDSA and would, therefore, not be subject to licencing requirements under the IHR. It should be noted, however, that subsection 3(1) (a)-(d) of the IHR may apply, should the product contain derivatives of industrial hemp seed, viable grain or non-viable cannabis seed. I have enclosed a copy of the Indusrial Hemp Regulations for your referece: https://laws-lois.justice.gc.ca/eng/regulations/SOR-98-156/FullText.html Regards, -- Industrial Hemp Section /Section du chanvre industriel Phone/Tlphone: (613) 954-7799
