Yes, but a shrewd CEO would now play on the "River" card. Investers holding debt either take a final offer (1 cent shares ) and agree to the consolidation or take zero and go home. We all LOSE and the company is sold to Big Mac and friends at half or 1/4 of the present price of shares. LOSE, LOSE.
