I sat through the court case allright, and could have prepared some rambling letter, but thought there must be more guys that have more to lose, like say people that invested alot more money in the shares, while I had more money in Debentures. I thought if the old TBE Board can't do a single thiing to support the company, maybe it really was just a pile of bad assets?
So I took my guidance from which way the Ad Hoc Debenture Holder Group would go, and had to wait and see what they would say. I was hoping they would file some challenge, in which case I would support it in any way possible, if the judge agreed. But it turned out they had contact with the Receiver's legal team, that wanted to difuse the situation, to show them that indeed the recovery was "substantial".
WIth the Ad Hoc Group not objecting to the deal, there was nothing to do. With no other shareholder saying a single thing, and not even bothering to show up in court, there was nothing to do.
I did raise some points with the Government, to question the fairness, but it turns out that small deals like this, are not looked at. So we'd have to change the regulations, in this rigged system.
All there is now, is to get the Government to pay for my losses, which they will partly do, through a "Capital Loss Carry-Back", on previous year's historical capital gains. At the current pace of devastation in the oil patch, I don't see the chance for many capital gains, for years to come.
So ultimately the Government will pay for my losses, through an income tax refund from previous good years. So once again, Canadians are sponsoring the looting of investments by foreigners, in their income tax system. Rather than have to do this, if the Government wasn't sleeping at the wheel, they would just cancel the deal, and agree to be a debt back-stopper, and ride out this low oil price cycle, that is currently slowly improving.
