The Supreme Court of Canada in its Dec. 2015 landmark decision on class action securities cases under the Ontario Securities Act centered on negligent or fraudulent misrepresentations has stated that to get leave for certification involving secondary market purchasers, they must have a reasonable chance of sucess at trial.
