very informative post lalli...Is it normal for the lawyers to ask for a 15,000$ fee before they could even tell you whether or not they have a case? That's why I'm finding it hard to send money to them when in the end they could easily say we don't have a case and take our 15,000$
Yes, lawyers don't give free advice on most cases except for injury and ambulance-chasing cases. But, I have never known people to pay for advice on class action lawsuits. If the case is good, you will have lawyers fighting for "carriage" of the case. Also, what happens if the lawyer says you guys have a "sure shot" winner based on his opioion, but his plates are full and he couldn't act as your lawyer. You can kiss your money goodbye then., or pay another $15,000 for a second opinion with another lawyer ? A lawyer's letter of opinion is worth nothing as you still need to go to trial. As the jokes goes, " You don't want a lawyer that knows the law, you want a lawyer that knows the judge". By the way, I would not want to be named as a representative plaintiff on behalf of the Class plaintiffs as you could personally be liable for hundreds of thousands in legal costs owing to the defense lawyers if your side loses. Legal costs are out-of-pocket expenses incurred by lawyers such as Expert Witness opinions etc. Be aware, and get assurance that you would not be liable for any costs.
