Yea, I've seen both of those articles before as well. I just know there are many big companies still putting up fights. I would imagine a few more wins in the court of law will make some case law on the topic and in the next year big insurance companies will be addressing this "issue" in their coverage policies!

Case Law is what is Key to make the large insurance companies roll over. You need a bunch of them to set the a precedent as well! once its set, they will change things because they will know they can't win.
