As such, the exclusivity, never mind any deal, is done.  Legallities take semantics and word usage seriously and that is why it is worded the way it is.  At this stage, they are evaluating an exclusive arrangement based on the outcome of their trials.  

 I gave the stars by the way. It was a clear and reasonable post.
