I am not sure how much of that agreement was revised when HPQ outright purchased the IP rights to Purevap for manufacture of Silicon from Quartz, but that agreement you are quotng from looks like the original agreement. i.e. HPQ now owns the IP, but is still required to pay royalties.
This may not make any difference to what you are saying overall, just a point of accuracy I think.
