Cannabis is a controlled substance under the Controlled Drugs and Substances Act. To reduce the risk of diversion, factors such as physical capacity (size of building, physical security considerations, number of staff, cultivation technique), sale capacity, and inventory levels are considered before issuing a licence. Canada also reports annual production and consumption figures and inventories to the International Narcotics Control Board.
Health Canada conducts routine inspections of licensed producers of cannabis for medical purposes, to verify their ongoing compliance with the regulations. It is expected that licensed producers of marijuana for medical purposes will take timely and appropriate corrective actions when any issue of non-compliance with the ACMPR is brought to their attention. Compliance is normally achieved through a cooperative approach between the regulated party and Health Canada; however, Health Canada has various tools of enforcement available, from warning letters and seizures to licence suspension, revocation and prosecution.
