I'm sure Aphria has done their due diligence and has received letters of comfort / opinions from their legal advisors both in Canada and the United states that what they are doing is allowable. Its a gutsy move that not all companies would make.
From a common sense point of view, if private companies in 30 states can now apply for a license to sell medical cannabis, why should the TMX stop Canadian companies from doing business in those states? If the US Federal governemnt is not preventing those states from having a leaglized medical marijuana system "today" then why should the TMX prevent Canadian listed companies from participating?
Yes thing might change next week, next month or next year, but that can be said for any legislation.
Bottom line is Arizona, Florida and soon to be Ohio have, at the state level, a system in place to sell medical cannabis and the US federal government is allowing it to continue.
