UPDATE: Adelanto Cannabis Related Ordinances
The following is an update to my earlier (Aug 9, 2017) post on Adelanto cannabis related ordinances (link).
 
Over the last weekend, an updated agenda was posted on the City of Adelanto meeting calendar (here) for the August 15 Planning Commission meeting.
 
The Planning Commission is putting forth a resolution (PC-17-47) to approve a newly drafted Ordinance 579. Ordinance 579 essentially adds regulations that explicitly allow for nursery operations within the already existing Adelanto Municipal Code (AMC) section 17.80.080 on cannabis cultivation. This ordinance is quite benign as the meat of it is really only about half a page long (see page 7 of the link below) and I would suspect this is not controversial like the volatile manufacturing issue (Ordinance 572) that underwent several rewrites. I really would not expect any push back from the Planning Commission or the City Council on this ordinance.
 
For anyone new to the process, here is how this will work in order to be fully sanctioned allowing companies to run a nursery operation.
 
  • August 15 - Planning commission approves resolution PC-17-47 thereby giving a recommendation to the City Council to approve Ordinance 579
  • Future City Council meeting (the next meeting after the one tomorrow, which does not have Ordinance 579 on the Agenda, is August 23) will undergo a 1st reading of Ordinance 579
  • A second future meeting of the City Council will undergo a 2nd reading of Ordinance 579
  • Assuming both hearings above pass with no comment/objection, Section 4 of the ordinance has the familiar language that says "this Ordinance shall take effect 30 days after its final passage"
  • Bottom line is that we may be looking for at least a 45 - 60 day period from now until nurseries are officially permitted as part of cultivation operations
 
I don't view this delay on the startup of nursery operations as a major issue. LDS may need to use alternative nursery supply for their initial cultivation batch.
 
Interestingly, this is the first ordinance that references the Medical and Adult Use Cannabis Regulation and Safety Act (“MAUCRSA”) as per below:
 
WHEREAS, on April 28, 2017, the State Department of Food and Agriculture issued Proposed Regulations for the Medical Cannabis Cultivation Program (“Proposed Regulations”) implementing MCRSA and detailing the comprehensive State licensing and regulatory framework for the cultivation of medical marijuana; and
 
WHEREAS, on June 27, 2017, Governor Brown signed Senate Bill 94 into law to combine MCRSA and AUMA into a single regulatory scheme known as the Medical and Adult Use Cannabis Regulation and Safety Act (“MAUCRSA”); and
 
WHEREAS, while the Proposed Regulations were adopted under MCRSA and predate MAUCRSA, and therefore may be subject to changes, MAUCRSA does not change the Department of Food and Agriculture’s authority to regulate the cultivation of medical marijuana; and
 
WHEREAS, both the Proposed Regulations and MAUCRSA provide for licenses for outdoor cultivation, indoor cultivation, nursery operations, and processor operations; and
