If the part is working properly and the PIT results verify that the unit saves the predicted fuel amount, then one could argue, the part that was defective caused a loss of revenue during the effected period of time.
I would argue get up and running with the new part and get the orders in, strengthens your case against the original parts supplier!

Who was doing quality control?
Let's hope the part works fine as they said it does, and the PIT delayed testing has given the truck enough time to blow off the carbon build up to meet the fuel savings as expected!
