Btw, as per my understanding, it is not a foregone conclusion that the third party who is funding the arbitration will definitely get 33% of the award. Company, on the website mentions that company's share of award can be reduced 'by up to one third'. To me, that implies a sliding scale. E.g., third party gets only 20% at full award of $387M, but gets 33% at $200M award and so on. This is just illustrative to make a point.
