RE:RE:INSURANCE - consider liabilityYou could make that same argument about any safety feature/device - as nothing is infallible.  The fact remains that owners of places of assembly have a duty to make things as safe as possible for their guests.  And insurance companies offer discounts on premiums as an incentive to property owners who install safety equipment.
