Response from BoD with respect to EO's Court ActionJust had a chance to read the NR with respect to EO's latest action. I am not a lawyer, but after a quick reading I don't see that EO has a good case against the "Affected Directors", noting that he now included Priya Patil (but not Robert Geis?). The language of the case is rather vague, so it would be difficult for the court to find out what he really wanted.

It would be a good idea for some one that is in the Toronto area to give Mr. Henry a call to find out AZX plan for this. I would expect something very simple, e.g. "the case is judged without merit and the BoD will vigourously defend the company, etc..." E-mail would help, but calling would be better in this case.

Also, it may be good to pass along to Messrs. Henry and Gundy a message that AZX United has over 51Ms, over 8.9%FD or 10.8%OS. This group would be willing to support Management and BoD if the price for AZX is right.

The above voting power assumes a 100% voters' turn-out (580Ms). If only 50% is voting then our voting power would increase by a factor of 2 (i.e. 8.9%FD of 540M would become 51.7Ms/290M = 17.8%). A 75% voters' turn-out would give 51.7Ms/326M =15.8% of the votes.
