Takeovers hostile (and friendly) can b initiated anytime for sure.
There're a lot of reasons for that to occur.
The devil would be in pricing that event given ROI's current situation.
Aside from a few random ad hoc gamblers - it seems that the market is simply keeping it's powder dry while there's this limbo time before the next steps are known in the litigation arena.
Corp. responses to the Marksman hearing are expected this week - and those responses might make this story a whole lot more interesting. And fast. And make pricing a potential takeover an easier task too:)
