For example, when Samsung lost $1bn in a patent case to Apple, they appealed and ultimately received a reduction in the amount owed by almost half. It can send a bad message to other perceived "patent trolls" if Apple were to just give-in and pay right away without fighting more. Apple employs a scorched earth policy to let every other potential litigant know that any lawsuit against them will be painful.

But even Apple know when to hold and when to fold. The Court Decision was decisive and Apple knows that. The Judge told Apple to use this week to resolve the outstanding claims and a Judge will not do that unless a Judge is sending a strong message- which is the case. So Apple can appeal and stall- knowing they are in defiance of the Judge request OR they can threaten to stall and use it as leverage to negotiate a complete settlement with QTRH that will remain under more confidnetial terms. I am predicting or maybe just HOPING the later.
