Is Colombia’s renewed ban on marijuana possession even constitutional?

October 1, 2018

The former President of Colombia’s Constitutional Court said Monday that a decree by President Ivan Duque to persecute marijuana users “goes against the constitution.”

The former president of Colombia’s Constitutional Court Alfredo Beltran said the new law could be an unconstitutional attack on personal freedom.

Drug policy experts called the president’s initiative “a step backwards.”

Duque signed a presidential decree on Monday which reversed Colombia’s drug laws in regards to drug possession of his predecessor Juan Manuel Santos.

Until Sunday, citizens were legally allowed to carry 20 grams of cannabis or one gram of cocaine for personal use.

But the new decree gave police the power to confiscate small amounts of drugs in what the government’s says is an effort to combat organized crime, particularly drug dealing.

“I think that goes against the constitution,” the former president of the Constitutional Court told radio station La FM, adding that Duque’s controversial initiative would be a “very dangerous step for personal freedom.”

The court in 2012 approved a government proposal to decriminalize the possession of small amounts of cocaine and marijuana for personal use.

Duque – who took office in August – made it one of his campaign promises to reverse the law on the possession of drugs.

His pledge has come under attack from those who believe it will do nothing to combat the country’s problem with drug dealing and drug abuse, will be a waste of money and police time and hasn’t gone through the obligatory legislative procedures.

Colombian human rights NGO Dejusticia and research group The Research Consortium on Drugs and the Law (CEDD) both put together a letter to Duque asking him not to sign the decree – saying it is “a step backwards, a costly idea and also stigmatizes drug users.”

We consider that the measure is inefficient and expensive, it does not contribute to advance the solution of the drug problem and, on the contrary, it promotes discrimination and stigmatization of people who use them.

 Dejusticia and the CEDD

Despite labeling himself an “extreme centrist”, Duque’s plan is in line with the ideology of his hard-right Democratic Center, and that of his patron, ex-president Alvaro Uribe.

Both Uribe and other members of the Democratic Center have said casual drug users should be treated as criminals and face severe penalties for possession.

Positive thinking needed
Is the actual business plan on track ? 700,000 sq ft to be added to the 300,000 at Aphria One and 1,000,000 at Aphria Diamond on track with state of art robotics and self contained electrical co generation. Low cost production and positive Ebitda. Any one looking at a real business after the NYSE listing will be impressed to buy a sustainable business. A multinational relationship with Diageo and/or Pharma is in progress. As shareholders we focus excessive energy on daily share price swings. Recent selling by Scynthian has put pressure on sp but that will end and we have enormous LATAM resources to show for it. Remember just 3 weeks ago the entire float was turned over at much higher prices .......
