D6 Super Senior Facility Loans ( CRAZY)I went through 4th amendment for the facilites agreement to find that ..lenders were already planning for this in 2016! lol


The Borrower agrees that the Lenders shall have the exclusive right to provide D6 Super Senior Facility Loans as D6 Super Senior Facility Lenders. If the Borrower wishes to utilise the D6 Super Senior Facility then it shall notify the Agent accordingly and thereafter each Lender shall have the right to provide D6 Super Senior Facility Loans and enter into a D6 Super Senior Facility Accession Agreement to reflect the same. If more than one Lender offers to provide D6 Super Senior Facility Loans, each such Lender shall be entitled to participate in such proposed D6 Super Senior Facility Loans ratably in the proportion that its Commitment bears to the Total Commitments of all Lenders offering to provide such D6 Super Senior Facility Loans.
