I am not totally in agreement with you. This may not be illegal to sell shares you do not own since I guess when they created the legislation, they left the door opened for this kind of nonsense. I challenge you to go out in the real worls and try to sell a house, a car or any kinds of goods/property that you don't own and watch out. This is called fraud.
