Shares are always available to short. Unless they are up for sale. The problem is buying back the shares when nobody is selling actual shares, there is a huge naked short that can’t be covered basically. Whoever gets stuck with it will have to either cover their short by prying 40% of the company out of insider’s hands, OR they will have to pay up for their naked short once the share price goes too high.
