Aphria Inc. APHA

Aphria, which is headquartered in Ontario, produces and sells medicinal and recreational cannabis. The company operates through retail and wholesale channels in Canada and internationally. Aphria is a main distributor of medical cannabis to Germany and has operations in over 10 countries outside of Canada. However, it does not have exposure to the U.S. CBD or THC markets due to the constraints of federal prohibition. It has some U.S. exposure through the acquisition of SweetWater, a craft brewer

Two reasons for the rebuttal still not being issued:

Instead of company issues their own account of the situation with short sellers report (this was probably initially intended), they rightfully decided to leave it to Special Committee of Independent Directors. This is completely a right decision  by Apha as a/ the Committee report bear more credibility and b/ with a number of litigation cases pending, this is by far safest option at Company’s disposal.

The company judgment was that loosing some of the stock value caused by delay in rebuttal (waiting for Committee report), it is way better option (stock could recuperate after the rebuttal) than to get caught in legal wrangling caused by company’s own account of events. This however requires more time than initially thought as Committee may need to exchange information with different participants including some foreign bodies and entities.

This by no means justify the CEO’s slip of tongue (“around Wednesday” phrase), nor this can justify  his profound luck of respect for company’s shareholders i.e. his inability to communicate this reasons properly.
